TERMS OF USE
The VITALISE Discovery Portal (VDP) (henceforth "VDP" or "Platform") offers its users information regarding and the means to process research data (henceforth “data”). VITALISE is a Research project (henceforth “Project”) funded by HORIZON EUROPE. The platform is operated by the CEntre for Research and Technology Hellas (CERTH) on behalf of the VITALISE consortium.
THE ROLE OF CERTH
According to GDPR, CERTH constitutes the controller being responsible for the processing of personal data of the academic community as well as for defining the personal data to be under processing, the procedures, the means and the purpose of the processing in accordance with the requirements of the GDPR and Greek law 4624/2019 .

By accessing the VDP, and any other linked platforms administrated by CERTH, the user (henceforth “User”) agrees to accept the Terms of Use that are subject to EU 2016/679 - General Data Protection Regulation (GDPR) of April 27, 2016,Greek Law 4624/2019 and any other Greek legislation for the protection of personal data, electronic communication, and intellectual property.

VITALISE DISCOVERY PORTAL CONTENT
The VDP is used “as is”. The administrator of the VDP has measures in place to secure that unauthorized users are not permitted to alter its content. CERTH has the capability and responsibility of modifying the content of this platform without modifying the current Terms. Recurring Users should check these Terms of Use and any possible revisions, before using the platform.
This VDP provides information regarding the platform and data including without limitation:
- Descriptive metadata of the uploaded datasets (Title, Description, Publisher, License etc)
- Scientific Datasets
- Publishing organizations and data authors
- Analysis of scripts and experiments that were executed

INTELLECTUAL PROPERTY RIGHTS
Unless otherwise specified, all content in the VDP, including but not limited to: logos, brand names, photos, texts, videos, and in general all files and source code, is subject to copyright by certh and the respective collaborating partners, under Greek, European and International legislation.
The data cannot be wholly or partly copied, modified, reproduced, retransmitted, deleted, republished, sold, run, published, or transmitted by any means by any user, without proper attribution to the VITALISE project and/or the respective collaborating partners.
The User can use (print, copy, store) abstracts from the content of the VDP and is obliged to cite the Project and the location in the VDP that it was found. Furthermore, the content is available for personal, research and/or educational purposes and not for commercial use or other purposes. It is clarified that the ability to use said content for personal, research and/or educational purposes does not mean that CERTH grants intellectual property rights.
The user shall not carry out any activity aimed at the re-identification of the data.
If a user finds information within anonymized, shortened or synthetic datasets that they believe might permit identification of any individual, they will report this information promptly by emailing
vitalise-helpdesk@googlegroups.com, citing the location of the specific information in question. Logos of third parties, organizations, associations, and sponsors are their own intellectual and industrial property, and as such, they are in control for their respective rights for use. Photos and applications of third-party logos, organizations, and other third-parties are subject to intellectual property rights and protected under national, European, and international legislation for intellectual property.
HYPERLINKS
These Terms of Use apply to this VDP only, and not for platforms owned and operated by third parties.
This VDP may link through hyperlinks to other platforms, where the owners of said platforms have the full responsibility (civil and penal) for the security, integrity, and legality of their content and services, such as intellectual property rights. The Users are obliged to know and accept the terms of use of said platforms and contact their owners for any issue that occurs from the use of their platform.
CERTH cannot guarantee the quality and the validity of the content and/or the security methods used by linked platforms. If the User decides to access through the links a platform of a third party, does so under their own responsibility.
VALIDITY OF TERMS OF USE
By using the VDP, the User is expected to have perused these Terms, and if disagrees is advised to not use it. CERTH retains the right to modify these Terms of Use in the future.
By accessing and using the VDP and any available information provided, the User unequivocally accepts the Terms of Use and conditions that apply for the content, including landing pages, images, graphs, photos, videos, and/or files.
This platform is addressed to adults. Minors under 15 years can access this platform under the supervision of a parent or guardian who can understand and accept the Terms of Use. CERTH has no statutory liability if users below the age of 15 access the platform and its content.
LIABILITY DISCLAIMERS
CERTH is bound to make every effort for the whole content, and relevant information, to be accurate, true, and complete. CERTH is not responsible for any form of damage caused to the User due to their actions by accessing the VDP taking into consideration these Terms of Use.
Moreover, VDP bears no responsibility for indemnification of any damage caused by Users of this Platform, or other third parties, for reasons related to the availability and/or use of the Platform, to any failure to access information provided by the Platform, or any unauthorized third-party interference on information available through the VDP.
CERTH is not able to guarantee that the services and functions of the Platform and/or servers will be uninterrupted, without any errors or malware, regardless if this applies to the Platform, or any other platform or server used to transmit the content.
USERS’ OBLIGATIONS
The Users accept and agree that they will use this VDP appropriately and are bound not to use the VDP for illegal activities. In case of illegal use or violation of the Terms of Use of the VDP, the Users are obliged to compensate CERTH for any damages done. Not acting on said rights does not automatically mean that CERTH forfeits said rights.
USER CONSENT & PERSONAL INFORMATION
In order to access certain services, such as the registration to the platform, CERTH may request to verify User's information. The information entered by the User must always be correct, complete, and accurate. Users are responsible for their actions while accessing the VDP and are required to notify the administrator of the VDP for any (including possible) violation of security. Personal data that Users provide will not be disclosed to third parties outside the Project’s partners under any condition. In order to offer certain services (ability to upload data, process data etc.), the User may need to provide voluntarily certain personal information. The processing of said personal data is subject to the Privacy Policy of CERTH, the General Data Protection Regulation and country’s GDPR laws (Greek law 4624/2019).
By accessing the VDP, the User may state if they consent to receive newsletters from the Project about news, programs, and events organized by the Project.
APPLICABLE LAW
The aforementioned Terms of Use and any modifications are governed by Belgian legislation. For any issue that may arise from this contract, the applicable courts for any complaints are the courts in Brussels-.
The original language used for drafting these Terms of Use is English. In the event of differences that may arise between the English versions of the Terms and potential translations, the version of the Terms in English shall prevail.
